Firm loses RM1m appeal

PUTRAJAYA: A Cheras firm has lost an appeal against a RM1 million judgment of the High Court in favour of a German company over an imitation product supplied to the Education Ministry.

The Court of Appeal panel comprising justices Tengku Datuk Baharuddin Shah Tengku Mahmud, Datuk Zainun Ali and Datuk Abu Samah Nordin dismissed the appeal with costs on May 9.

The appellants were MS Instruments Sdn Bhd, Ng Guan Long and Yap Heng Suah.

On March 23, 2006, the High Court ordered them to pay GUNT Geratebau GmbH RM1 million in general damages, plus eight per cent interest per annum from Dec 8, 1999 for passing off an imitation product and supplying it to the ministry as the genuine product of the German company.

GUNT was represented by Datuk Suhaimi Kamaruddin, Marisa Regina Mohd Aris Rizal and Saidatun Nasihah. - Bernama
