MCA will not call another EGM

KUALA LUMPUR: MCA secretary-general Datuk Wong Foon Meng will not call for an extraordinary general meeting (EGM) requested by 16 central committee members last week to pave way for fresh party polls.

Wong said in a statement today the proposed motions by the group were "unconstitutional and unworkable" according to the opinion of the party's new legal chief, Lim Hong San.

The legal bureau said that a fresh election was constitutionally held every three years and it could not be forced unless the general assembly had dismissed any party official by a two-third majority or at the central committee level, at least two-thirds of those elected ceased to be members and the remaining members within three days elected one of them to convene an EGM to elect a new central committee.

"Similarly, the General Assembly cannot force or direct any Central Committee (CC) Member to resign unless it comes within the ambit of Article 45.24 of the Party Constitution," Wong added.

On the second proposal by the group to nullify any appointment made by the president after Oct 10, when the party held its EGM, Wong said it was against the powers vested in the president to make or terminate appointments. - Bernama
