PUTRAJAYA: The on-going final appeal hearing of opposition leader Datuk Seri Anwar Ibrahim enters its fifth day.

Lead prosecutor Tan Sri Dr Muhammad Shafee Abdullah will continue the submission today before the five-man Federal Court bench chaired by Chief Justice Tun Arifin Zakaria. IT comprised also of Court of Appeal president Tan Sri Md Raus Sharif, Tan Sri Abdull Hamid Embong, Tan Sri Suriyadi Halim Omar, and Tan Sri Ahmad Maarop.

Below is the timeline.

He added while Anwar brought in a bottle of water from outside, his DNA was also collected from a towel, toothpaste and toothbrush given to him in the jail cell by the authorities.

1.15pm: Anwar says he is convinced that his defence counsel will debunk allegations based on scientific evidence. Anwar also praised judges for carefully deliberating on scientific facts.

1.04pm: Proceedings to be continued tomorrow to allow Shafee to wrap up his submissions on DNA and Anwar's failure to prove his alibi.

12.46pm: Shafee noted that Osman's credibility is further damaged by his oral evidence that plastic was inserted into Saiful's anus which he admitted was added into his report after meeting Saiful.

12.25pm: Shafee noted that Pusrawi Hospital medical officer Dr Mohamed Osman Abdul Hamid's credibility (as a defence witness) is affected by asking Saiful basic questions like who sexually assaulted him when Saiful came to him for medical examination after the alleged sodomy incident.

11.53am: Shafee again told the court that Saiful's testimony having used words like "lagi (again)" and feeling pain "every time" (during penetration) indicate previous encounters between Anwar and Saiful.

11.38am: Proceedings resume.

11.15am: Tun Arifin Zakaria seeks 15-minute recess. Proceedings will resume at 11.30am.

11.14am: Shafee said the three doctors who later examined victim Mohd Saiful Bukhari Azlan could not say there was penetration initially because lubricants may had been used. He told the bench that it may be because no undue force was used against Saiful by Anwar and also due to delay in Saiful seeking medical examination.

11.08am: Shafee said DNA cannot change its identity by mere degradation. He noted that chemist Dr Seah Lay Hong had testified that under microscope, she found only sperm head in the sample. He said this is good enough as sperm head has the best DNA one can find.

10.47am: Shafee said prosecution witness chemist Dr Nor Aidora Saedon testified that she analysed the bottle, towel and toothbrush months after chemist Dr Seah Lay Hong analysed them and found the DNA profile there to also match the Male Y DNA found on Anwar's underwear.

10.32am: Shafee argued that the towel, toothbrush and bottle retrieved from Anwar's cell were admissible because of the probative value of the evidence to the whole case being higher than their prejudicial value.

10.12am: Shafee told the Federal Court that the High Court itself had allowed the towel, toothbrush, and bottle to be admitted as evidence due to legality of Anwar's detention.

10.06am: Shafee noted that prosecution witness Investigation officer ASP Jude Blacious Pereira had testified that the arrest of Anwar was made because Anwar refused to give his DNA sample while at Hospital Kuala Lumpur.

10.02am: Shafee submitted the three items retrieved from Anwar's cell; the mineral water bottle, the towel, and the toothbrush; were admissible as Anwar's arrest was legal and involved no trickery by the police.

9.59am: Shafee said Anwar's arrest was lawful as he refused to give a sample for DNA testing.

9.52am: Shafee contended that Anwar's arrest was lawful because he was shown the warrant of arrest and charge sheet by the police.

9.41am: Shafee said prosecution witness investigating officer ASP Jude Pereira's testimony supported the notion that Anwar brought in the mineral bottle where his DNA was later extracted.

9.37am: Lead prosecutor Tan Sri Muhammad Shafee Abdullah said there's reasonable inference Anwar used the towel, mineral bottle and toothbrush inside his cell as the items were found on the floor after he left the cell.

9.23am: About 50 supporters Mohd Saiful Bukhari Azlan’s gathered near the road close to the court while shouting “Hukum.. Hukum.. Hukum... Hukum Anwar”
