28 retired judges file suit for readjustment of their pensions

KUALA LUMPUR: Twenty-eight retired judges and seven dependants of former judges have filed a lawsuit against the government seeking an adjustment in their pension scheme.

They named the government, prime minister, Cabinet ministers, and Public Services director-general as the first, second, third, and fourth defendants.

The plaintiffs filed the lawsuit via Messrs. Chooi & company + Cheang & Ariff at the High Court here last week.

According to the originating summons, the plaintiffs were aggrieved by the unconstitutional situation of their non-adjustment pensions, which were protected under the Federal Constitution.

"The plaintiffs, through their solicitors, sent a notice of demand to the government on Sept 17 last year.

"However, there has been no response to the notice," it said.

The plaintiffs claimed that the adjustment of their pensions was and is provided for by Section 15B of the Judges' Remuneration Act 1971 (Act 45).

The plaintiffs, including judges who served in the Federal Court, the Court of Appeal, the High Court of Malaya and the High Court of Sabah and Sarawak are:
