Court fines former AADK personnel RM10,000 for corruption [NSTTV]

ALOR SETAR: The Sessions Court here today fined a former National Anti-Drug Agency (AADK) personnel RM10,000 after he pleaded guilty to two alternative charges of receiving a bribe six years ago.

Judge Harmi Thamri Mohamad passed the sentence on Erwan Yahya, 46, for committing the offence while serving as Kuala Muda AADK assistant in 2016.

Under the first alternative charge, Erwan was accused of accepting an RM3,000 bribe for himself from civilian Muhammad Russul Muhammad Radzi as an inducement to release a man who tested positive for methamphetamine.

He committed the offence in a Proton Iswara while driving past a row of shophouses in Bandar Puteri Jaya, Sungai Petani, about 5.30pm on Dec 7, 2016.

On the second alternative charge, Erwan was jointly accused with AADK officer Norzarenawati Osman, 38, of accepting RM3,000 bribe from Muhammad Russul as an inducement to release a man who tested positive for drug abuse at a vacant house in Bandar Puteri Jaya about 3pm on the same day.

He was charged under Section 165 of the Penal Code (Act 574) which carries up to two years' jail or a fine, or both upon conviction.

Malaysian Anti-Corruption Commission (MACC) deputy public prosecutor Tan Siew Ping prosecuted while the accused was represented by lawyer Alias Ibrahim.

In mitigation, Alias pleaded for leniency as his client was remorseful after his marriage collapsed following the incident.

"His marriage was ruined and he lost his job, and depends on a meagre income doing odd jobs. He also suffers from diabetes.

"My client was also involved in an accident on Feb 8, leaving him with injuries to his ribs and right knee that forced him to use crutches to walk," Alias said.

However, the prosecution urged the court to impose a heavy sentence as he had committed the offence while serving as a civil servant and also as a deterrent to the public.

The accused paid the fine.
