Man fined RM10,000 over indecent pictures

KOTA KINABALU: A man who sent pornographic pictures to a woman via Facebook Messenger was fined RM10,000 in default six months' jail.

Abdul Wahab Ismail, 30, who appeared before Sessions Court judge Noor Hafizah Mohd Salim pleaded guilty to two charges today.

On the first and second counts, Abdul Wahab had sent the pornographic pictures via Facebook Messenger on Sept 4, 2019, at 9.56pm and Oct 9, 2019, at 10.36pm, respectively, at a village in Bongawan, Papar.

He was convicted for improper use of a network facility under Section 233 (1) (a) of the Multimedia Communication Act 1998, punishable under Section 233 (3) of the same Act which provides for a fine of up to RM50,000 or a jail term of up to one year or both.

The court imposed RM5,000 fine in default three months' jail for each charge.

Following a report lodged by the woman, a raid was carried out and several items were seized, namely a cellphone, a simcard and a micro SD card.

The accused, who was unrepresented, asked for leniency saying that he was in prison for more than a year for a previous conviction.

Malaysian Communications and Multimedia Commission (MCMC) prosecuting officer Nazrul Nizam Zameri asked for a deterrent sentence to be handed to Abdul as a lesson for the accused and the public.

In an unrelated case, a company and its director were fined a total of RM6,000 by the same court here for selling an uncertified wireless microphone and audio video sender.

East-Con Trading Sdn Bhd and the director Chai Gua Fang, 60, had two charges each.

The court imposed RM1,500 fine or three months' jail for each charge. The offences were committed on June 23, 2020, and March 11, 2020, respectively.

It was mandatory for the two electronic items, namely audio video sender and wireless microphone, be certified by the Standards and Industrial Research Institute of Malaysia (SIRIM).

The company and Chia paid the fine of RM6,000.
