Owner, shop assistant fined over pharmaceutical-related offences

KOTA KINABALU: A mini market owner and his employee were fined by the Sessions Court here over pharmaceutical-related offences.

Edwin Unding, 36, was fined RM3,500 while his shop assistant, Perenccey Endih, 35, was fined RM1,500.

The duo pleaded guilty before judge Elsie Primus to committing their respective offences on Sept 10, 2019, at 11.25am in Kota Belud.

In Edwin's case, on the first count he was fined RM1,500 in default one month's jail for having 57 boxes of Novomin containing diphenhydramine, a type of scheduled poison under the Poisons Act 1952.

Diphenhydramine is commonly used to prevent and treat nausea, vomiting, and dizziness caused by motion sickness and under law can only be dispensed by licensed personnel.

The offence under Section 13(a) of the Poisons Act 1952 is punishable under Section 32(2) of the same act which provides for a fine not exceeding RM3,000 or imprisonment of up to a year or both, upon conviction.

On the second count, Edwin was fined RM2,000 or one month's jail for having four types of unregistered aromatherapy oil which contravene Regulation 7(1)(a) of the Control of Drugs and Cosmetic Regulations 1984.

The offence under Section 30(1) of the Drugs and Cosmetics Control Regulations 1984, is punishable under Section 12(1) of the Drugs Sales Act 1952 and carries a fine or a jail term of up to three years or both, upon conviction.

Perenccey was fined RM1,500 in default one month's jail for selling a box of Novomin.

The offence falls under Section 16(5) of the Poisons Act 1952 and punishable under Section 32(2) of the same act.

Prosecuting officer Tan Pueh Li prosecuted while both accused were unrepresented.

Edwin and Perenccey paid their fines.
