Man gets six years' jail for raping underage girl

KOTA KINABALU: The Sessions Court here sentenced a man to six years' jail for raping a 15-year-old girl.

Abdullah Ahlun, 21, pleaded guilty before judge Dayang Ellyn Narisa Abang Ahmad.

He committed the offence on Feb 23, last year, between 2pm and 3pm at a rented room in Inanam Baru.

The offence is under Section 376(1) of the Penal Code, which carries imprisonment for up to 20 years and whipping.

According to the facts of the case, the accused and victim checked into the room after only having known each other for a few weeks through WhatsApp.

The accused registered the room using the victim's name as he had no identification document.

He paid RM50 rent for an hour. The incident came to light when the victim's mother saw a "love bite" on her daughter's neck on Feb 26 last year at 10.30pm.

She lodged a police report which led to the accused's arrest the next day.

The mother also brought the victim to a hospital for examination, which later confirmed that there was a fresh tear in the victim's hymen.

In mitigation, the unrepresented accused, who is a Filipino and worked as a cigarette seller, asked for leniency saying he did not force the girl.

Deputy public prosecutor Suryati Jumain urged for a deterrent sentence because of the seriousness of the offence.

Abdullah will be referred to the Immigration Department after completing his sentence.
