Pregnant woman gets 14 days' jail for using another person's MyKad

KOTA KINABALU: A pregnant foreign woman, who used her friend's MyKad, for a check-up at a hospital, was sentenced to 14 days' jail by the magistrate's court here.

Nursita Nulhasan, 26, from the Philippines, pleaded guilty before magistrate Lovely Natasha Charles.

She admitted to using another person's MyKad at Women and Children's Hospital in Likas here on March 11 at 4.15pm.

The offence under Section 25(1)(o) of the National Registration Regulation 1990 (Amended 2007), provides for a jail term of up to three years or a fine upon conviction.

The facts of the case stated that Nursita, who works as a waitress, went to the hospital for a check-up.

A complainant who attended to her in the assessment room found that the picture on the MyKad was different, which led to her arrest.

When inquired, Nursita claimed she was using her friend's Mykad.

In mitigation, the unrepresented accused asked for a lenient sentence saying she is a single mother and eight months pregnant with her first child.

She told the court that she was born in the Philippines and had been in Sabah for six years. She claimed she had no one here except her foster sister, and that she only used the MyKad for her maternity checkup.

Inspector Kelvan Elson Maik urged for a deterrent sentence and told the court that Nursita had been sentenced to 14 days' jail by the Immigration Court here for entering Sabah illegally.

The court ordered Nursita to serve her jail sentence from the date of her arrest and to be referred to the Immigration Department after completing her sentence for further action.
