All MCO flouters treated the same, statement recorded upon arrest

KUALA LUMPUR: All alleged offenders of the Movement Control Order (MCO) will be treated alike with their statement taken first upon arrest, said Senior Minister (Security Cluster) Datuk Seri Ismail Sabri Yaakob.

"According to the law, each individual arrested will have his statement taken first," he said during his daily press conference today.

Ismail Sabri was responding to a question on standard operating procedures (SOP) following confusion among the public that there were some who were hauled straight to court upon arrest while others had their statements taken first.

He said it was not up to the police to determine whether an alleged offender should be charged but the Attorney-General Chambers (AGC).

"After the police take the statement, an investigation paper will be opened and submitted to AGC and the latter will decide whether to charge the person or not.

"So, the SOP is the same for each individual arrested before they are taken to court," he said.
