YDP Agong disappointed Emergency Ordinances revoked without consent

KUALA LUMPUR: Yang di-Pertuan Agong Al-Sultan Abdullah Ri'ayatuddin Al-Mustafa Billah Shah today expressed disappointment over the statement made in the special Parliament sitting recently that the government has revoked the six Emergency Ordinances introduced during the State of Emergency period.

The king was referring to the statement made by Minister in the Prime Minister's Department Datuk Seri Takiyuddin Hassan, who had revealed during the special sitting that all of the ordinances were revoked on July 21.

In a statement today, Comptroller of the Royal Household of Istana Negara, Datuk Ahmad Fadil Shamsuddin said Article 150(2B) which is read together with Article of 150 (3) of the Federal Constitution stipulated that the powers to amend and revoke the ordinances falls under the prerogative of the king.

"The Yang di-Pertuan Agong has expressed extreme disappointment with the statement made during the Parliament sitting on July 26 that the government has revoked all Emergency Ordinances proclaimed by His Majesty for the state of Emergency period although the revocation (of the ordinances) have not been consented by His Majesty.

"The Yang di-Pertuan Agong has expressed his disappointment that what has been previously consented and agreed with Datuk Seri Takiyuddin Hassan and Attorney-General Tan Sri Idrus Harun during their audience that was conducted virtually on July 24 for the proposal to revoke all ordinances to be presented and debated in the Parliament was not implemented.

"The Yang di-Pertuan Agong would like to stress that the statement made by the minister during the sitting on July 26 is not accurate and that it has misled members of the Dewan Rakyat," said Ahmad Fadil in the statement.

He added that the king also stressed that the application to revoke the ordinances effective July 21 without the matter being tabled and debated in Parliament was made in a rush and that the statement over the matter has misled the Parliament.

Such an action, he said, does not only tantamount to the failure of respecting the principle of the Rule of Law as enshrined in the Rukun Negara but also went against the function and prerogative of His Majesty as the Head of the State as provided in the Constitution.

"The Yang di-Pertuan Agong is aware that His Majesty should act on the advice of the Cabinet as stated in Article 40(1) of the Constitution.

"However, the Yang di-Pertuan Agong is of the view that as the Head of the State, His Majesty has the duty to advise and reprimand if there is any action that goes against the Constitution by any quarters, especially by those who have been tasked to discharge the function and powers of the Yang di-Pertuan Agong," read the statement.

Ahmad Fadil added that the Yang di-Pertuan Agong also stressed for all members of parliament to focus on finding the solution to the problems faced by people at a time when the country is still battling from the crises brought about by the Covid-19 pandemic, during the on-going special parliamentary sitting.

"The Yang di-Pertuan Agong also took the opportunity to call on the people to pray that the country would continue to be protected and prevented from any forms of disaster and that the Covid-19 virus could be immediately eradicated," he said.
