KJ: Control of Tobacco Product and Smoking Bill to also regulate e-cig, vape

KUALA LUMPUR: All importers and manufacturers of tobacco products, tobacco substances or substitute products to be sold in the Malaysian market are required to register their products under the proposed Control of Tobacco and Smoking Bill.

Health Minister Khairy Jamaluddin said Clauses 3, 4, 5 and 6 of the proposed law covered provisions on the requirements to register the abovementioned products.

"The provisions are important and critical to allow all tobacco products, substances or tobacco substitute products to have their specifications and contents recorded.

"The registration of the products would make the enforcement process easier, including helping to identify unregistered tobacco products, substances or tobacco substitute products," he said in his speech in tabling the bill for second reading today.

Vape or e-cigarette sellers, who have been running their businesses illegally, would be able to register their products, he said.

Clauses 7, 8 and 9 deal with prohibitions on advertisement, promotions and sponsorships that extends such rules to all smoking products such as e-cigarettes and vape, as well as on illicit tobacco products, substances and substitutes to tobacco products.

"During the tabling of the bill, I refer to the terms e-cigarette and vape.

"I would like to attract the attention of the Dewan, that the words 'e-cigarette' and 'vape' are not specifically provided in the bill, but they are included in the terms of smoking devices, substances and substitutes to smoking products.

"Clause 13 specifies prohibition of sales and purchase of any tobacco product, substance and substitutes to tobacco products by any individuals born on Jan 1, 2007 onwards."

The clause was a new proposal to replace the prohibition of sale to those aged under 18 under the existing law, he said.
