GEORGE TOWN: A Sessions Court here acquitted and discharged Seri Delima assemblyman R.S.N Rayer from a sedition charge over his "Celaka Umno" remark at a ceramah two years ago.
Sessions court judge Roslan Hamid said the prosecution has failed to prove a prima facie case against the DAP lawmaker.
"While the prosecution has proved that he has said those words in his speech, it has failed to prove the seditious element as Umno is not a racial group but a political group," he said during his 10-minute decision today at the end of the prosecution's case.
Roslan said the prosecution had also failed to prove a prima facie case against Rayer for an alternative charge, under Section 504 of the Penal Code for intentional insult with intent to provoke a breach of the peace.
It was reported that Rayer had been accused with uttering the seditious words, "...tapi Umno ini celaka...," at a ceramah held at the field in Jalan Delima, Island Glades, Jelutong at 10pm on May 22, 2014.
Rayer was charged under Section 4(1)(b) of the Sedition Act 1948, with an alternative charge of Section 504 of the Penal Code.
