KUALA LUMPUR: The Syariah High Court here today postponed the proceeding for the two children of a couple who was killed in an accident on the Duta-Ulu Kelang Expressway in May 2015 to testify in their custody case.

Syarie judge Abu Zaky Mohammad postponed the proceeding after allowing an application by the children’s grandmother, Wirda Syamsuddin, 55, for a review of the decision made by Syarie judge Muhamad Abdul Karim Wahab last March 15 in ordering the children to testify.

The children, Nur Firuza Amira Fairuz Nizam, 10, and seven-year-old Nur Firuza Aqila Fairuz Nizam, were ordered to appear in court today to testify whether they want to stay with Wirda, or their aunt, Yusnidah Hussain, 50, who was given temporary custody of the two girls since Aug 11, 2015.

The court was told that the notice for the review was filed at the Syariah Court of Appeal last March 22.

Following which, the court set May 14 for case management.

Yusnidah filed the application for permanent custody of the two children on June 2, 2015 in accordance with Section 81 of the Islamic Family Law (Federal Territory) Act 1984, She named Wirda as the defendant.

In the crash on May 2, 2015, Fairuz Nizam Husain, 35, and his wife, Nova Safitri Azhari, 27, as well as their six-month -old baby, Nur Firuza Annisa, were killed while the family was returning home to Taman Muda, Batu Caves near here. --BERNAMA
