Mavcom: MYAirline has until tomorrow to justify why it should keep its air service license

KUALA LUMPUR: The Malaysian Aviation Commission (Mavcom) has given MYAirline Sdn Bhd's management until tomorrow (October 27) to submit a written justification to keep its air service license (ASL).

Mavcom said in a statement today, that it issued a show cause letter to MYAirline a day after it suspended operations on October 12, 2023.

The show cause letter, specifies MYAirline's failure to fulfil its ASL, including unsettled employee salaries and benefits.

The commission said it will decide whether it should revoke MYAirline's ASL or allow it to continue to be an ASL holder under section 43(1) of the Malaysian Aviation Commission Act 2015 [Act 771], upon receiving MYAirline's written justification.

Mavcom has commited to providing additional updates to the public within one week.

In addition, Mavcom is further investigating MYAirline for other possible breaches of its ASL conditions.

On October 16, 2023 the Civil Aviation Authority of Malaysia (CAAM) suspended MYAirline's Air Operator Certificate (AOC) for 90 days, pending further investigations.

On October 25, 2023 CAAM said it is re-auditing the carrier's AOC renewal checklist, targeting specific technical areas including the airline's Continuing Airworthiness Maintenance Organisation and Approved Maintenance Organisation.

Mavcom has also set-up a task force made up of representatives from the commission, the legal, regulatory & dispute resolution committee and consumer protection committee to look into affected passengers' refunds and to provide recommendations on the way forward.

"While the existing licensing approval framework that applies to all new and existing licence holders is comprehensive, the task force amongst others, will also be reviewing the framework for enhancement," Mavcom said.

With regards to the refunds, Mavcom said it has engaged various agencies, including Bank Negara Malaysia, to seek all possible avenues to refund affected consumers. It will provide additional updates on refunds to the public in due course.
