Actor loses suit over drama set graffiti

KUALA LUMPUR: An actor lost his suit against pay television operator Measat Broadcast Network Systems Sdn Bhd(Astro) and two others over alleged defamatory graffiti in local comedy series "Kapoww".

High Court judge Datuk Lau Bee Lan ruled in chambers today that plaintiff Mohd Syahini Hassan failed to prove the black spray-painted wall scribbles on the set of episode four of Kapoww referred to him.

Counsel Razlan Hadri, who appeared for Kapoww director Azizi Adnan, one of the defendants, said today the court found on a balance of probabilities that the black graffiti did not refer to Mohd Syahini.

He said that the court ruled that the words were just part of the background on the drama set.

Razlan added that Mohd Syahini was ordered to pay RM50,000 cost to Kapoww producer Tayangan Unggul Sdn Bhd, one of the defendants, and Astro, as well as pay RM30,000 cost to Azizi.

Defendant Anamorphic Studio Sdn Bhd, Kapoww's co-producer, had a judgment in default entered against it in previous proceedings.

Counsel Datuk S. Arumugam, who represented Mohd Syahini, said he will discuss with his client whether to appeal the verdict.

Mohd Syahini, 41, popularly known as Shah Hassan, was present at court today.

Mohd Syahini, according to the suit filed on Sept 7, 2010, claimed he found the defamatory wall scribblings when he visited the drama's filming location on June 7 the same year.

He had sought an injunction to restrain the defendants from broadcasting Kapoww's fourth episode.

He had also sought, among others, general and aggravated damages, loss of current and future income, interests, cost, and any other relief deemed fit by the court.
