Nik Nazmi sues AG and govt over Blackout 505 second charge

KUALA LUMPUR: Parti Keadilan Rakyat (PKR) Youth chief Nik Nazmi Nik Ahmad filed a civil suit against Attorney-General Tan Sri Abdul Gani Patail and the government for malicious prosecution linked to his Blackout 505 charging.

The Seri Setia assemblyman filed the suit through his lawyers Eric Paulsen and Melissa Sasidaran at the High Court registry here early this afternoon.

Nik Nazmi, 33, claimed that he was recharged at the Sessions Court after the same court discharged him of a similar offence earlier following a Court of Appeal declaration that Section 9(5) of the Peaceful Assembly Act 2012 was unconstitutional.

The plaintiff was first charged on May 17, 2013, for allegedly taking part in an illegal assembly at Stadium Majlis Bandaraya Petaling Jaya, Kelana Jaya, Petaling Jaya, around 8.30pm on May 8 the same year.

The court discharged him on May 5, 2014. Nik Nazmi was recharged on May 6 the same year, however the court later discharged him on the same day.

Nik Nazmi seeks unspecified geenral, exemplary, and aggravated damages, RM80,000 in special damages, five percent interest, cost and any other relief deemed fit by the court.
