Company director charged with 17 counts of CBT for not remitting MTD of staff to IRB

KEMAMAN: A director of Perwaja Steel Sdn Bhd was charged in the Magistrate’s Court here today with 17 counts of criminal breach of trust (CBT) for not remitting the monthly tax deduction (MTD) of the company staff, involving more than RM3.6 million, to the Inland Revenue Board (IRB).

However, the accused, Tan Sri Pheng Yin Huah, 67, was not in court and was represented by the company’s legal adviser, Victor Teoh, who pleaded not guilty to all the charges.

During the proceeding before Magistrate Rofiah Mohamad, Teoh also requested for the matter to be settled out of court.

Pheng, as a representative of the company entrusted under Section 75 of the Income Tax Act 1967 to remit the MTD of its staff to IRB, was charged with committing CBT by not remitting the MTD of nearly 300 staff to IRB from January 2013 until May last year.

The matter was discovered following an audit visit by the Kuala Terengganu IRB on June 25 last year.

The prosecution was conducted by prosecuting officers from IRB, Mohd Arif Zaini and Zulhasymi Mohammad.

The court set Aug 24 for mention. – BERNAMA
