Director charged over false statement related to share-allotment

KUALA LUMPUR: A director of a financial consultancy firm claimed trial to making false statement over the allotment of its more than two million shares to three different companies.

Datuk Mohamad Zahari Awang, director of TU-E Capital Bhd, was charged at the Sessions Court today with committing the offence over the allotment of 2,205,000 shares to Lightning Land Sdn Bhd, Pubel Kaolin Mining Corporation Bhd, and Pubel Bedford Capital Limited.

The charge alleged that Zahari, 57, made the statement in Form 24 despite no payment in relation to the allotment were ever made into the account of TU-E Capital.

The offence allegedly took place at the Companies Commission of Malaysia headquarters at Menara SSM@Sentral at No. 7, Jalan Stesen Sentral 5 here, on Sept 28, 2010.

Zahari may be jailed up to 10 years, fined RM250,000, or both if convicted under Section 364(2) of the Companies Act 1965.

Judge Zulqarnain Hassan granted RM3,000 bail with one surety and ordered the accused to surrender his passport to the court. Zulqarnain fixed Sept 15 for mention.

Counsel acted for Zahari while deputy public prosecutor Muhammad Afif Abdullah prosecuted.
