AG's Chambers to raise objection in Khairuddin case

KUALA LUMPUR: The Attorney-General's Chambers (AGC) will raise an objection against ex-Umno leader Datuk Seri Khairuddin Abu Hassan's bid to review its decision to close three cases involving Prime Minister Datuk Seri Najib Razak.

Khairuddin's counsel Mohamed Haniff Khatri Abdulla told reporters that Tan Sri Mohamed Apandi Ali will file the objection against his client's judicial review at the High Court here on March 3.

The matter was confirmed by senior federal counsel Shamsul Bolhassan.

Meanwhile, the court fixed March 18 to hear Khairuddin's application to review Apandi's decision to not prosecute Najib on the RM2.6 billion donation issue, and on abuse of powers in transferring funds from Kumpulan Wang Persaraan (KWAP) to SRC International.

Deputy registrar Nor Hasniah Ab Razak fixed the date after the matter came up for case management in chambers today.

She also fixed March 3 for submissions.

In his application filed on Feb 3, Khairuddin, 54, had sought for a mandamus order for the Malaysian Anti-Corruption Commission (MACC) to consider the next course of action on the commission's three investigation papers dismissed by Apandi.

The former Batu Kawan division deputy division chief also sought a declaration that Apandi had no authority to order the MACC to close investigations as his appointment was invalid.

He claimed that Apandi cannot be appointed as the AG as his predecessor Tan Sri Abdul Gani Patail's removal was not in accordance with Article 145(6) of the Federal Constitution.

The article provides that an AG can only be removed or replaced by the Yang di-Pertuan Agong based on the legal provisions in which the dismissal was approved by the medical board if he or she was found sick.
