KUALA LUMPUR: The Malaysia Competition Commission (MyCC) has obtained High Court leave to proceed with its legal bid to reinstate the RM10 million fines against Malaysia Airlines (MAS) and AirAsia over its allegedly anti-competitive market-sharing agreement.
MyCC's lawyer Sharon Chong Tze Ying confirmed the decision made by judge Datuk Nik Hasmat Nik Mohamed in her chambers today.
MyCC, through its judicial review application, seeks to nullify the Competition Appeal Tribunal's decision on Feb 4, which allowed the appeal by MAS and AirAsia to set aside the fines.
Chong said that Nik Hasmat granted leave to MyCC because the matter was of public interest.
Counsel Leonard Yeoh represented AirAsia.
MyCC's judicial review application would come up for further case management on Aug 15.
On March 31, 2014, MyCC levied the fines on MAS and AirAsia when it ruled that both airlines had signed an agreement to share the market in Malaysia's air transport services sector.
The RM10 million fines were based on MAS and AirAsia flights from Jan 1 to April 30, 2012.
