Selangor gov't says redelineation exercise unconstitutional; to apply for judicial review against EC

SHAH ALAM: The Selangor state government will be filing an application tomorrow for a judicial review against the notice and recommendations by the Election Commission (EC) of its proposed redelineation exercise.

Selangor Menteri Besar Datuk Seri Azmin Ali said the application will be filed by counsel Datuk Ambiga Sreenevasan and Datuk Cyrus Das at the Kuala Lumpur High Court (Appelate and Special Powers Court) in the morning.

Speaking during a press conference at the state secretariat building today, Azmin said the documents pertaining to the application are currently being updated.

He said preliminary studies carried out by experts show that the notice and recommendations of the EC on the redelineation exercise violates the Federal Constitution.

"Evidence from experts proves that the proposal and recommendations by the EC (amount to) malapportionment and serious gerrymandering. The information (provided) by the EC is not sufficient for voters to exercise their right to submit the protest, and it also violates the multicultural (realities of) Selangor.

"Voters and the society of Selangor have enjoyed a harmonious working relationship for the last many decades, and now the EC is coming in and trying to break these boundaries and push one race to one particular area, as well as bring a different race to a different area, which is not healthy for a state like Selangor and (a country like) Malaysia.

"As the chief minister in Selangor, and along with the state executive councillors, we believe the exercise by the EC has violated the multiculturalism of Selangor. Therefore, the state government feel we (must) defend the system of democracy and the rights of the rakyat in Selangor," said Azmin at the state operations room.

He said the aim of the application of judicial review is to ask the court to cancel the notice and recommendations proposed by the EC.

"We ask that the court also issue an order to stop the EC from proceeding with the enquiry process until this judicial review is heard in court. Based on the information we have received, the EC is hastily carrying out the enquiry, which has started in Sabah.

"We also want to ask the court to issue an order for all the proposals and recommendations by the EC to be in compliance with the Federal Constitution," said Azmin.
