High Court dismisses appeal for sentence enhancement, man remains free

KUALA LUMPUR: A man who was released from prison after completing his jail sentence for forging documents for a RM4 million property purchase remains free when the High Court dismissed an appeal to enhance his sentence.

Judge Datuk Azman Abdullah upheld Wong Zaf Ning’s, 35, nine months jail sentence over his conviction on Sept 15, last year.

He made the decision after dismissing an appeal by deputy public prosecutor Aznika Mohd Anas to enhance the accused’s jail sentence.

“The magistrate’s court could have imposed a fine on the accused...now the accused has completed his jail term and the victim did not suffer any losses,” the judge said in dismissing the appeal.

Wong’s jail sentence began from the date of his arrest on Sept 15, 2016.

He was represented by counsel, Leonard Yeoh.

On April 20, 2015, Wong was charged with three counts of document forgery for the purchase of a property worth RM4 million.

On the first count, he was charged with using the forged ‘Facilities Agreement’ between Ambank and him and his business partner, Yang Libo, a Chinese national.

On the second count, he was charged with using another forged document, “Offer For Banking Facility: RM1,990,000’ from Ambank dated Oct 7, 2011, and on the third count, using another forged document, ‘Offer For Banking Facility: RM1,000,000’ from Ambank dated July 25, 2012.

The offences were committed at Menara Ambank, No. 8, Jalan Yap Kwan Seng, here on Jan 17, 2012; Oct 21, 2011 and Aug 10, 2012, respectively.

His charge under Section 471 of the Penal Code carries a maximum jail term of two years, or fine, or both, upon conviction.
