KUALA LUMPUR: The serial "pedestrian kicker" near the Bank Negara building was back in the magistrate's court again, and this time he was sentenced to a year's jail for assaulting an analyst.
Jobless Marmi Zabrin Mian, 34, pleaded guilty to two charges before magistrate Rahni Kartini Abd Rahim.
"I plead guilty, I plead guily," said the accused who was released from prison in July for kicking pedestrians from behind.
On the first count, Marmi was charged with causing hurt to Bank Negara analyst Or Su Lin, 34, by kicking her from behind causing her to fall on her back.
He committed the offence at the pedestrian bridge in Jalan Raja Laut, Dang Wangi here, at 1.30pm on Nov 6.
On the second charge, he was accused of assaulting Or at the same place and time.
When the charges were read to him, he merely asked the court : "What does assault mean? What are the examples of an assault" to which the magistrate reprimanded him saying: "How could you not understand?"
Marmi then said he understood the meaning and pleaded guilty.
Deputy public prosecutor Ahmad Zikri Jaafar urged for a deterrent sentence saying that the accused had caused hurt to a woman in public and previously there were five reports lodged against the accused who used the same modus operandi on his victims.
"He follows his victims from behind and when they go down the stairs, he kicks them from behind causing them to fall.
"It is a serious offence as the victim sustains back injuries and all the reports involve women," he said, adding that the case involved public interest.
In pleading leniency, Marmi, unrepresented, claimed he was a government officer and had to take care of his mother.
"I plead for a minumum jail sentence or fine as my mother is old and ill. I have to take care of her," he said.
Rahni Kartini then sentenced Marmi to a maximum 12 months' jail and fined him RM1,500 or three months' jail on the first charge and three months' jail on the second charge.
She ordered the sentences to run concurrently from the date of the accused's arrest on Nov 8.
It was reported that the accused caused an uproar among netizens in July last year with his habit of kicking pedestrians from the back near the Bank Negara building.
He was previously arrested for kicking a pedestrian from behind near the same place and jailed three months.
