Ex-company director acquitted of providing false statement to Bursa Malaysia

KUALA LUMPUR: A former company director was freed by the sessions court here on Thursday of the charge of providing a false statement to Bursa Malaysia Securities Berhad eight years ago.

Judge Shamsudin Abdullah acquitted and discharged J Alan Rajendram, 61, without having his defence called after finding that the prosecution had failed to raise a reasonable doubt in the case.

Rajendram was charged with knowingly furnishing a false statement on the affairs of Linear Corporation Berhad, which was a listed corporation, in a general announcement by the company, dated Dec 29, 2009.

He was alleged to have committed the offence at Bursa Malaysia Securities Berhad, Exchange Square, Bukit Kewangan, on Dec 29, 2009.

The charge, made under Section 369 (b)(B) of the Capital Markets and Services Act 2007, provides for imprisonment of up to 10 years and a maximum fine of RM3 million, if convicted.

Securities Commission prosecuting officer Mohd Hafiz Yusoff prosecuted, while the accused was represented by counsel Datuk N. Sivananthan.

Thirteen witnesses were called to testify during the trial.
