KB court sends man to the gallows over murder, rape of housewife

KOTA BARU: A 25-year-old unemployed man was sentenced to death by the High Court here today after he was found guilty of murdering a housewife Kampung Batu Papan near Gua Musang in 2015.

Judicial Commissioner Datuk Ahmad Bache also sentenced Mohamad Awari Ahmad to 18 years’ jail and 12 strokes of rotan for raping the woman.

In the first offence, the accused was alleged to have murdered Yashmin Fauzi, 25, at a house in Kampung Batu Papan between 12.30 and 2am on Mac 1, 2015.

He was charged under Section 302 of Penal Code which carries the mandatory death penalty.

For the second offence, Mohamad Awari was alleged to have raped the victim at the same location at about midnight and was charged under Section 376 (4) of the Penal Code.

Shaharaliza Razak acted as deputy public prosecutor for the case while the accused was represented by lawyer Latifah Arifin.

Earlier, in the judgement, Ahmad said the court could not accept the excused given by the accused that he has no intention of murdering the woman.

"Based on his action of attacking the victim with a parang repeatly, it was clear that he has the intention to murder her.

"At the beginning, he only brought a piece of wood but later decided to take the parang from the victim's house. This showed that he has the intention," he said.

He said the incident was also witnessed by the victim's son, then aged five, who saw his mother being slashed on the neck.
