Kajang chicken coop murder: Two men, including ex-policeman, escape gallows

SHAH ALAM: Two men, including a former policeman escaped the death sentence after the High Court acquitted and discharged them of the murder of a man in a chicken coop in Kajang three years ago.

Judge Datuk Azmi Ariffin delivered the decision after the prosecution failed in establishing a prima facie case against Kamarul Zaimi Kamaruddin, 38 and former lance corporal, Mohamad Akir Abdul Aziz, 29.

In his judgment, Azmi said the prosecution had failed to establish a connection between the victim and the accused. “After thoroughly considered all the submissions, including written submissions, the court found that there was no element which could link the accused, whether directly or circumstantial, with the act,” he said.

Prosecution was conducted by deputy public prosecutor Shahida Wan Omar.

Kamarul Zaimi was represented by lawyer Rodzim Zaimy Abdul Hamid and counsel Diar Isda Yazmin represented Mohamad Akir.

A total of 19 prosecution witnesses were called during the hearing of the case which commenced earlier this year.

According to the charge sheet, the men, along with four others who were still at large, were accused of murdering Imra Nazli Rusdi, 31, on April 4, 2015.

They were accused of committing the offence at 10.09am at a chicken coop located next to a playground at Pinggiran Sungai Long 1, Pinggiran Sungai Long, Kajang.

They were charged under Section 302 of the Penal Code which carries a mandatory death penalty.
