Man gets 20 years' jail, seven rotan strokes for raping disabled daughter

SEGAMAT: A man was sentenced to 20 years in jail and seven strokes of the rotan after he was found guilty of raping his disabled daughter last year.

Sessions Court judge Rashidah Roslee handed down the sentence after the 51-year-old man changed his plea from not guilty to guilty.

The man was charged with raping the 13-year-old girl at their home in Batu Anam here between January and March 2018.

For the offence, he was charged under Section 376(2)(k) of the Penal Code, read together with Section 376(2) of the Penal Code, which provides for a jail term of up to 30 years and whipping upon conviction.

The accused also pleaded guilty to committing physical sexual assault against the victim the same house at about 6.45am on March 11, 2018.

For the offence, he was charged under Section 14(a) of the Sexual Offences Against Children Act 2017, which provides a jail term of up to 20 years and whipping upon conviction.

The court then sentenced the man to 20 years in prison and seven strokes of the rotan for the first offence, and 10 years in prison for the second offence.

Both sentences will run concurrently from the date he was arrested on March 20, 2018.

Deputy public prosecutor Suriani Ujang prosecuted while the accused was unrepresented.

According to the facts of the case, the victim's elder sister went home early on March 20 and caught her father raping her younger sister in the bedroom.

This was after she was informed by the victim's school that she had not been attending classes.

Medical checks on the victim showed that there was a tear on the victim’s private parts.
