CJ must address Justice Hamid's affidavit on judiciary misconduct

KUALA LUMPUR: The Chief Justice must immediately address the alarming revelations in Court of Appeal judge Datuk Hamid Sultan Abu Backer’s affidavit on the misconduct of the judiciary, said lawyer Sangeet Kaur Deo.

In a statement, Sangeet who is the daughter of the late Karpal Singh, said failure to do so will speak for itself.

She also criticised the Malaysian Bar for remaining silent on the issue.

"Despite having been served with a copy of the filed Court papers soon after the action was filed, the President of the Bar Council has also regrettably found it fit to remain silent on such a fundamental issue involving the integrity of the Malaysian Judiciary," she said.

Sangeet added this was an unprecedented and exceptionally bold move on the part of a serving Court of Appeal judge.

"Justice Hamid must be offered the protection that he now requires and he must also be given the opportunity to reveal further information which he says he has, through formal channels of inquiry," she said.

Sangeet added the issues plaguing the independence of the Malaysian Judiciary, which have long been wilfully ignored, are now public, and stakeholders, especially the Pakatan Harapan (PH) government, must not renegade on their duty to address this crisis.

"The honour of the Malaysian Judiciary is very much at stake," she said.

The 63-page affidavit was filed in support of Sangeet’s court application seeking a declaration that Chief Justice Tan Sri Richard Malanjum had failed to protect and defend the integrity of the judiciary regarding her late father’s sedition case.

Karpal was charged with uttering seditious words against the Sultan of Perak.

In the affidavit, Hamid had revealed explosive and detailed information in relation to numerous incidences of judicial interference within the Malaysian Judiciary.
