Trial for businessman involved in Ku Nan's graft case transferred to High Court

KUALA LUMPUR: The trial of businessman Datuk Tan Eng Boon, who was charged with bribing and abetting former Federal Territories minister Tengku Adnan Tengku Mansor five years ago, has been transferred to the High Court today.

High Court judge Mohamed Zaini Mazlan made the order after allowing Deputy Public Prosecutor Raja Lailawati Ali’s application to have the case transferred from the Sessions Court to the High Court.

The notice to transfer the case was filed on March 15 under Section 417 of the Criminal Procedure Code.

Earlier, counsel Faisal Moideen had asked for a stay of the transfer for the defence to file a notice of appeal against the order.

However, the court did not allow the stay application.

After the proceedings at the High Court, Lailawati informed Sessions Court judge Azura Ali who initially heard the case on the transfer of the case to the High Court.

On Nov 15, last year, Tan, who was also the director of a property company, was charged with bribing Tengku Adnan and abetting him five years ago.

He allegedly gave RM1 million via a Public bank cheque belonging to Pekan Nenas Industries Sdn Bhd, which was deposited into the latter’s CIMB bank account.

The monies were used as an inducement for Tengku Adnan for approving an application of a company to increase the plot ratio in Jalan Semarak, Kuala Lumpur.

The offence falls under Section 16(b)(A) of the Malaysian Anti-Corruption Commission Act 2009.

He was also charged with abetting Tengku Adnan for committing the corruption which falls under Section 109 of the Penal Code.
