AG on sex videos: No prosecution

KUALA LUMPUR: The sex video allegedly involving a politician which drew much interest among Malaysians in June last year, will not be the subject of any legal proceedings, for now.

Attorney-General Tan Sri Tommy Thomas said he made the decision not to prosecute any individuals or suspects implicated in the video, after investigation failed to positively identify the persons in the recording.

He said the poor quality and blurry images of the individuals in the videos could not be ascertained through facial recognition analysis conducted both, locally and also abroad.

"CyberSecurity Malaysia could not achieve a positive facial recognition on the two individuals from the video due to its poor resolution and recording quality," he said in a statemet today.

Tommy is referring to several video clips allegedly implicating a Federal Minister and a former political party's youth leader.

He added that forensic experts in the United States also concurred Cybersecurity's findings on the poor quality of recording which hampered the facial recognition on either of the two in the video.

“In these circumstances and upon reviewing evidence as presently gathered and submitted by the police to this Chambers, my deputy public prosecutors unanimously recommended to me that no charges be proffered in connection with the video.

“I have accepted their recommendation and have decided not to prosecute any person,” he said.

He informed that several reports for an investigation by different individuals had sparked the police to investigate the case under Sections 377B and 377D of the Penal Code, June last year.

Tommy said police received the result of the second analysis conducted in the US in Dec 2019 which stated the findings as: "The inability to identify individuals in the viral videos is primarily due to the low resolution and quality of the viral videos and the relatively few number of video frames in which the suspect is clearly visible”.

"This Chambers and the Royal Malaysian Police have followed the standard investigation protocol in reviewing the investigation papers on sex videos allegedly involving political personalities.

"We had numerous discussions to review the evidence gathered by police and several further investigation orders were also issued to ensure the sufficiency of evidence before any prosecutorial decision is made," Tommy said.

On Monday, Federal Criminal Investigation Department director Datuk Seri Huzir Mohamed had also made public that the individuals in the video could not be positively identified through facial recognition analysis.

He said the department had just received the report from forensic experts in the US on the video's authenticity and the failure to identify the two men in it.
