Deepak's suit against Najib and Rosmah dismissed

PUTRAJAYA: The Court of Appeal has affirmed the High Court's decision to strike out another suit by carpet dealer JR Deepak Jaikishan against Datuk Seri Najib Razak, his wife Datin Seri Rosmah Mansor and two companies over a land deal.

A three-man bench led by Datuk Hanipah Farikullah in dismissing the businessman's appeal, said the lower court had extensively considered the pleadings and issues in making the findings.

"We find that the High Court judge's findings are correct in law," Hanipah said in the unanimous decision, adding that the court was of the view that there was no error by the High Court that warrants any intervention.

The court ordered Deepak to pay costs of RM7,000 to Najib and Rosmah and the same amount to Boustead Holdings Bhd and its subsidiary Bakti Wira Development Sdn Bhd.

Judges Datuk Azizah Nawawi and Datuk See Mee Chun also presided in the proceeding which was conducted via Zoom.

Deepak was appealing against the High Court decision in July last year, which allowed the application by Najib, Rosmah and the two companies to strike out the suit.

He filed the suit on Oct 12, 2018, against the four, claiming that he had suffered losses due to the conspiracy, fraud and undue influence by them in a property deal that allegedly caused his company to suffer huge losses.

He had sought RM600 million in general damages, RM50 million in exemplary damages and RM26 million in aggravated damages.

On Sept 20, the Court of Appeal dismissed Deepak's appeal against High Court's decision to strike out his suit against the couple and Baling Member of Parliament Datuk Seri Abdul Azeez Abdul Rahim.

The suit which was filed by Deepak together with his company Carpet Raya Sdn Bhd and his brother Rajesh Jaiksihan was over tax arrears imposed on them for being proxies to the couple.
