Man jailed for life, ordered six strokes for growing marijuana

TAWAU: The Sessions Court sentenced a man to life imprisonment and six strokes of the rotan for possessing and planting 12 cannabis plants two years ago.

Judge Awang Kerisnada Awang Mahmud, sentenced Azril Surash Masree Samy, 45, after he was found guilty under Section 6B (1) (a) of the Dangerous Drugs Act 1952 which is punishable under Section 6B (3) of the same Act.

Earlier, Awang Kerisnada in his judgment said the had failed to raise a reasonable doubt to the prosecution's case.

The accused was arrested by a team of officers and members of the Narcotics Crime Investigation Division from the Tawau District Police Headquarters (IPD) who raided a two-storey terrace house at Taman Mega Ria, Batu 3 Jalan Air Panas, near here, at about 5.30pm on Aug 3, 2020.

When questioned, the accused admitted that he knew the plants were cannabis and that it was planted just for fun.

The accused was also sentenced to 14 months imprisonment on April 22 last year after pleading guilty to the charge under Section 6 of the Dangerous Drugs Act for possession of cannabis.

The prosecution was conducted by deputy prosecutor Raya Mohd Suhaimi Suriana while the accused was represented by lawyers Mark Rosaidey and Muhammad Nazreen Jaafar.
