Najib granted leave to reinstate SRC International ex-directors in US$1.8b suit

KUALA LUMPUR: Datuk Seri Najib Razak was granted leave to reinstate SRC International Bhd's former directors in the US$1.8 billion civil suit brought by the company against him.

High Court Judge Datuk Ahmad Fairuz Zainol Abidin today granted leave to Najib's to issue third-party notices against the six individuals who served the company between 2011 to 2015.

The six are former SRC managing director Nik Faisal Ariff Kamil, former chairman Tan Sri Ismee Ismail, as well as former directors Datuk Shahrol Azral Ibrahim Halmi, Datuk Suboh Md Yasin, Datuk Mohammed Azhar Osman Khairuddin and Datuk Che Abdullah @ Rashidi Che Omar.

SRC International, a former subsidiary of 1Malaysia Development Bhd (1MDB), had under its new management filed the suit in May last year, and had initially named Najib and the six as defendants.

The suit was over alleged breach of trust and breach of statutory duty in relation to the RM4 billion Retirement Fund Inc (KWAP) loans to SRC International.

However, the company removed the six individuals in the suit except Nik Faisal who was still at large.

In November last year, the court entered a judgment in default against Nik Faisal for his non-appearance after the suit was filed.

The court also ordered Najib to serve the third party notices on the six within two weeks.

Counsel Harvinderjit Singh who appeared for Najib said they would serve the notice as soon as possible.

The suit was filed as part of 22 civil suits by 1MDB and SRC International against various individuals and entities, including Najib, the companies' former directors and senior officers, foreign financial institutions, as well as fugitive businessman Low Taek Jho, more commonly known as Jho Low.

The issue on the KWAP loans received worldwide attention when Najib was sentenced to 12 years' jail and fined RM210 million by the High Court after he was found guilty of misappropriating of RM42 million of SRC International funds.

He is now serving his jail sentence at the Kajang Prison.
