Shahrir Samad's police report against Tommy Thomas classified as NFA [Updated]

KUALA LUMPUR: Police have classified former Felda chairman Tan Sri Shahrir Samad's abuse of power report against former Attorney General (AG) Tommy Thomas as 'no further action' (NFA).

Sentul police chief Assistant Commissioner Beh Eng Lai said all actions taken by Thomas were based on powers accorded to him as the AG.

"Thomas has absolute power as AG to decide on prosecution matters under Article 145(3) of the Federal Constitution.

"Therefore, we have classified the report as NFA. No further investigation will be conducted," Beh said.

Shahrir had previously lodged a report on Jan 13 accusing the AG of abusing his power in connection to the charges filed against him by Thomas for failure to declare RM1 million.

On Jan 5, Shahrir, who was the former Johor Baru member of Parliament, was granted full acquittal and discharge on all counts of failing to declare his actual income in the Income Tax Return Form for Assessment Year 2013 to the Inland Revenue Board, including the RM1 million he allegedly received from Datuk Seri Najib Razak in 2013.

High Court judge Datuk Muhammad Jamil Hussin ruled so after deputy public prosecutor Rasyidah Murni Azmi informed the court that the prosecution has received instructions from Attorney-General's Chambers (AGC) to withdraw the case against Shahrir.

During the trial, a witness, MACC investigating officer Nurzahidah Yacop, 35, said she received instruction from the prosecution, with permission given by Thomas on Jan 15, 2020, to charge Shahrir although the investigation papers on the case were still incomplete.

In a Facebook posting on Jan 9, Shahrir criticised Thomas and described the former AG as someone who was wise and experienced, but lacked integrity.

He claimed that Thomas had hauled him to court not to win the case, but to smear his image and to have him labelled as corrupt.

In the police report, Shahrir alleged that there was an element of malicious prosecution since he was a Barisan Nasional leader.

He also claimed that the court case had severely tarnished his reputation and that his family had been humiliated by being dragged into the case.
