Blood spatter on wall matches DNA of Cradle Fund CEO: Prosecution

PUTRAJAYA: The Court of Appeal was informed today that the blood spatter found on the charred walls of a room where Nazrin Hassan's body was discovered, matches the deoxyribonucleic acid (DNA) of the Chief Executive Officer (CEO) of Cradle Fund.

Deputy Public Prosecutor Mohd Amril Johari argued that Royal Malaysia Police forensics officer ASP Nizam Hussain (witness 39) confirmed that the bloodstains at the scene were consistent with the impact of a blunt object and not caused by gunfire or an explosion.

"SP39 also confirmed that the bloodstains on the wall were present before the fire because they were found beneath the soot. Based on SP39's testimony, it is clear that this witness is an expert with extensive experience and made observations regarding the blood spatter at the scene," he said.

He made these arguments during the prosecution's appeal against the Shah Alam High Court's decision to acquit Samirah Muzaffar, 48, the widow of Nazrin, as well as two teenagers, now aged 21 and 18, of charges of killing Nazrin, after the prosecution failed to establish a prima facie case against them.

To further bolster SP39's testimony, Mohd Amril stated that 15 cotton swabs containing blood spatter samples collected from the scene were sent to the Chemistry Department of Malaysia for analysis.

"After analysis, SP43, who is a Chemist at the Chemistry Department of Malaysia, S. Jayasilan, confirmed that three of the cotton swabs matched the deceased's (Nazrin) DNA profile. This further supports the prosecution's argument that the deceased's body was moved. Therefore, the defense's claim that the court should reject SP39's testimony holds no merit," he said.

Regarding the respondent's lawyers' argument that the blood spatter was only discovered five months after the incident on November 5, 2018, and DSP C. Tharmalingan (SP34) did not find any blood spatter when he visited the scene, despite being a more experienced forensic officer in Bukit Aman, Mohd Amril stated that the witness was never questioned about the blood spatter on the wall.

"SP34 provided detailed explanations about his role in the case, and during cross-examination by the defense during the trial, he mentioned that he took the floorboard as evidence to conduct DNA profiling in support of the assertion that the deceased died at the scene. SP34 never provided any information about blood spatter," said Mohd Amril.

The appeal, heard before a panel of three judges led by Judge Datuk Vazeer Alam Mydin Meera, sitting alongside Datuk Ahmad Zaidi Ibrahim and Datuk Azhahari Kamal Ramli, will continue on October 23.

On June 21, 2022, the Shah Alam High Court acquitted all three accused of the charge of murdering Nazrin at the end of the prosecution's case.

Samirah and the two teenagers, as well as Indonesian national Eka Wahyu Lestari, who remains at large, were accused of killing Nazrin, 45, at his Mutiara Damansara home between 11.30 pm on June 13, 2018, and 4am the following day.
