Lewd Facebook post to female cop lands man in court; RM7,000 fine and jail term looming

KUALA LUMPUR: A 49-year-old man was fined RM7,000 by the Sessions Court for sending a lewd Facebook post to a policewoman two years ago.

Judge N Priscilla Hemamalini meted out the sentence against Mohamad Fatariza Abd Hamid after he pleaded guilty to the offence today.

The court also ordered the father of three to serve six months in jail if he fails to pay the fine.

According to the charge sheet, Fatariza is accused of creating the insulting post with the intent to hurt the feelings of others via his Facebook account 'Fatariza Hamid' at 2.13am on July 30, 2021.

The message was read at the police Cyber and Multimedia Crime Investigation Division, KPJ Tower at 11.05am on the same date.

He was charged under Section 233(1)(a) of the Communications and Multimedia Act 1998, which carries a maximum fine of RM50,000 or a jail term not exceeding a year or both upon conviction.

Earlier, deputy public prosecutor Nurilya Ellyna Nor Azmal asked the court to impose a deterrent sentence against the accused.

However, lawyer Salmi Hamdan Sabran who appeared for the accused pleaded for a minimum sentence.
