'Up to AGC to decide whether to reinstate charges against Zahid'

KUALA LUMPUR: It is up to the Attorney-General's Chambers (AGC) to decide whether to reinstate corruption charges against Deputy Prime Minister Datuk Seri Dr Ahmad Zahid Hamidi.

Malaysian Anti-Corruption Commission (MACC) chief commissioner Tan Sri Azam Baki said officers from the graft busters are still carrying out investigations into the matter.

"I will leave it to the AGC to decide (on the matter). As for the MACC, our officers are still investigating the matter as we told the court," he told reporters here today.

Azam was asked to comment if Zahid would likely have the charges against him reinstated similar to that of former prime minister Tan Sri Muhyiddin Yassin.

It was reported yesterday that the Court of Appeal (CoA) allowed the prosecution's appeal to reinstate four abuse of power charges made against the Pagoh member of parliament linked to the Jana Wibawa programme during his tenure.

Justice Datuk Hadhariah Syed Ismail, who led a three-member panel in a unanimous decision, ruled so when granting the prosecution's application to set aside the High Court's decision to acquit and release the 76-year-old in August last year.

On Aug 15 , High Court judge Datuk Muhammad Jamil Hussin struck out the case linked to Jana Wibawa programme, ruling that all four charges were defective and in bad faith.

About a month later, the High Court granted the deputy prime minister a discharge not amounting to acquittal of 12 criminal breach of trust charges, eight counts of bribery and 27 for money laundering, involving millions of ringgit belonging to Yayasan Akalbudi (YAB).

Azam was also asked on the Court of Appeal's decision to reinstate the abuse of power charges against Muhyiddin.

"The case has been decided by the court."

"And the AGC, the MACC deputy public prosecutor involved (in the case) and the lawyers involved will discuss with the courts on the actual date of the court proceedings."
