KUALA LUMPUR: Former prime minister Datuk Seri Najib Razak claimed it is prejudice if Attorney-General Tommy Thomas was allow to continue leading the prosecution team in the criminal breach of trust (CBT) and power abuse case against him.
In his originating summon filed against Thomas, Najib said the former had written an article entitled “Grand Larceny in 1MDB” on July 2016, which concluded he (Najib) had taken the money from 1MDB.
The article was published on news portal MalaysiaKini.
“Thomas’ stand is clear that he does not like me, which was reflected in the article, and this causes concern that he may find means to ensure and prefer a charge against me for any reason.
“The article clearly shows that Thomas has his own stand against me and I feel that I will not been given a fair consideration.
“Thomas should and is not qualified to be involved in the investigation into 1MDB by any means,” said Najib in his supporting affidavit.
The former Barisan Nasional chairman, through his counsel Badrul Abdullah, had filed three separate suits against Thomas and two others, who are top investigators involved in the probe on 1MDB, on June 30.
The other respondents are Malaysian Anti-Corruption Commission (MACC) chief commissioner Datuk Seri Mohd Shukri Abdull, and Bukit Aman Commercial Crimes Investigation Department chief, Datuk Seri Amar Singh Ishar Singh.
In ex-parte application filed against Shukri, Najib said the former, during a press conference held after he was appointed as the new MACC chief, had prematurely concluded that he had taken RM42 millions and RM2.6 billion from SRC International Sdn Bhd.
Najib stressed that the press conference was conducted before he was summoned by MACC to have his statement recorded to assist investigation into SRC International.
He said the statement made by Shukri during the press conference was emotionally-charged and vengeful apart from portraying him as guilty.
“By making such statement, the integrity and professionalism of Shukri can be disputed. He was supposed to take a neutral stand until investigation into the case has been completed but he chose to punish without solid foundation.
“In this situation, I feel that I will not be accorded to an investigation, which is just and transparent,” he said.
Meanwhile, Najib, in his supporting affidavit for his originating summon against Amar Singh, said the Bukit Aman Commercial Crimes Investigation Department chief was responsible in leading police raid at premises resided by his children at Pavilion Residence and one loaned by a friend to store items moved from his official residence in Seri Perdana.
Najib said the raid by Amar Singh and his team did not comply with the Standard Operation Procedure. He also said a report has been lodged against Amar Singh.
“I have also instructed Tetuan Badrul, Samad, Faik & Co to file an official complaint on the non-compliance to the SOP to the Integrity Commission,” he said.
Najib contended that Shukri is not qualified to lead the MACC investigation team as well as to be a member in the 1MDB task force. He also said Amar Singh is not qualified to advise the investigation team form to probe the case.
A police report, said Najib, has been lodged over the actions of Thomas, Shukri and Amar Singh.
Lawyers representing Najib and the respondents are scheduled to meet with two judges for separate pre-trial hearings on July 16.
