23 cases heard under new Review of Death Penalty Act, no rejections yet

KUALA LUMPUR: A total of 23 out of 1,020 applications under the Review of Death Penalty and Life Imprisonment Act 2023 (Federal Court Temporary Jurisdiction) (Act 847) have been heard and decided by the Federal Court.

As of today, no applications have been rejected by the Federal Court.

Deputy Minister in the Prime Minister's Department (Law and Institutional Reform), Ramkarpal Singh, said that out of the 23 applications under Act 847, 15 involved reviews of death penalty sentences, and eight involved reviews of life imprisonment sentences.

He mentioned that the Prisons Department has completed filing all 1,020 applications for review under the Review of Death Penalty and Life Imprisonment Act (Act 847).

"The coordination of filing for the review process has been carried out by the Legal Affairs Division, Prime Minister's Department (PMD) to ensure a smooth and organised review process.

"For transparency purposes, the review process flowchart was uploaded to the website and all social media platforms of the Legal Affairs Division, PMD, on Sept 12, 2023, and is open for public reference," he said.

Furthermore, he stated that at the Federal Court case management stage, appointed lawyers representing the inmates for the review process will also be provided with fundamental trial documents such as the charge sheet, court order, and judgment grounds from previous trials and appeals.

He explained that after filing the review applications under Act 847, if the lawyers representing the inmates in this review process need more time to submit any additional supporting documents or to prepare their cases, any extension of time can be requested from the court.

"The decision on the extension of time is subject to the court's discretion, as is the common practice in any case before the court," he said.
