China-based company and subcontractors fined for neglecting safety, leading to worker's death

KOTA KINABALU: A China-based company and its two subcontractors were fined by the Sessions Court here for neglecting safety aspects, resulting in the death of their worker.

China Railway Engineering Corporation (Sabah) Sdn Bhd was fined RM30,000 in default 60 days imprisonment for carrying out its operation without providing safe electrical equipment which caused a fatal accident to Sisal Ramlie, 29.

Sisal was electrocuted to death.

The incident took place in a room on the fifth floor near a lobby lift of a proposed high-rise condominiums in Jalan Bundusan, Penampang on Apr 26, 2023, between 7.30pm and 8pm.

The offence under Section 17 (1) of the Safety and Security Act Occupational Health 1994, is punishable under Section 19 of the same Act.

Meanwhile, IIS Controls Sdn Bhd and Fiberlink Solutions Sdn Bhd were each fined RM8,000 for not installing a safe lamp extension cable that led to the fatal accident at the same time and place.

The offence under Section 15 (1) of the Occupational Safety and Health Act 1994 is also punishable under Section 19 of the same Act.

Both indictments provide for a fine of up to RM50,000, or a jail term of up to two years, or both, upon conviction.

Prosecuting officer Elisa Eligius Samuel from the Occupational Safety and Health Department prosecuted the cases before judges Noor Hafizah Mohd Salim and Amir Shah Amir Hassan.

The China-based company was represented by its safety and health officer while the two subcontractors were represented by their director.
