MYCC serves proposed decision on eight contractors suspected of bid rigging

KUALA LUMPUR: The Malaysia Competition Commission (MyCC) has served a proposed decision against eight enterprises for allegedly participating in bid rigging related to two Public Works Department (PWD) tenders and one Department of Drainage and Irrigation (JPS) tender in 2019.

In a statement today, MyCC chairman, Datuk Seri Mohd Hishamudin Yunus said the proposed decision was made on April 16 against the enterprises for suspected infringement of Section 4 of the Competition Act 2010 and duly served on Monday (April 22).

Six of the enterprises, namely, Dutamesra Bina Sdn Bhd; IDX Multi Resources Sdn Bhd; Mangkubumi Sdn Bhd; Menang Idaman Sdn. Bhd; Meranti Budiman Sdn Bhd, and Pintas Utama Sdn Bhd are implicated in all three tenders.

Whereas, NYL Corporation Sdn Bhd is implicated in both the PWD tenders, while Kiara Kilat Sdn Bhd is implicated in one of the PWD tenders.

"These three tenders are worth approximately RM473 million in the provision of services for construction works for roads and flood mitigation systems.

"The investigation has provisionally found that these enterprises had colluded in bid rigging through information sharing and coordination in the participation of the above-mentioned tenders," he said.

Mohd Hishamudin highlighted that it is important to note that MYCC's findings are provisional and should not be interpreted as conclusive evidence of infringement of the Competition Act 2010 by any of the enterprises at this point.

He noted that the enterprises concerned have also been notified of the proposed penalties and accorded the opportunity to submit their respective written representations within 30 days of receiving the proposed decision, as required by the Act.

"Thereafter, the enterprises have the additional opportunity to make their respective oral representations before the commission at a date to be determined later.

"MyCC will only issue its final decision after considering representations made by the enterprises as against evidence gathered from the investigation," he said. — BERNAMA
