First MH370 lawsuit settled

KUALA LUMPUR: The suit brought by two young boys who lost their father in the disappearance of flight MH370 against Malaysia Airlines System Bhd (MAS) and four others has been resolved.

The suit was settled after the plaintiff had filed a notice of discontinuance of the suit against the defendants and had made the withdrawal with no liberty to file anew.

Judge Rosnaini Saub recorded the withdrawal in chambers today with no order as to cost.

The suit was filed on Oct 31 last year through the boys' mother Ng Pearl Ming, 40, naming MAS, Civil Aviation Department director-general, Immigration director-general, Royal Malaysian Air Force chief and the government as defendants.

The boys, aged 14 and 12, are seeking general damages over the loss of their father, Jee Jing Hang, 41, a businessman earning a monthly income of RM16,865, and supplemental damages due to their suffering.

On Feb 17, Rosnaini had advised parties to settle the matter following the government’s Jan 29 declaration that the MH370 incident was an accident.

Counsel Datuk Dr Arunan Selvaraj, who represented the siblings, said the matter has been settled.

“The matter has finally been concluded and as we all know, authorities have declared the incident as an accident in January. They have also assured that the next of kin would be compensated fairly," he said.

He added that his client had agreed to accept the compensation and will move on with their lives.

However, Arunan did not reveal any details on the compensation amount.

The defendants were represented by Federal Counsel Saiful Nizam Shahrin.
