July 13 for MIC-RoS appeal hearing

PUTRAJAYA: The Court of Appeal set July 13 to hear the appeal against a Registrar of Societies (RoS) directive for MIC to hold re-election.

Senior federal counsel Amarjeet Singh confirmed the date set by Court of Appeal president Tan Sri Md Raus Sharif during case management today.

Amarjeet represented the RoS, who is the respondent during the chamber matter today.

Counsel Jadadish Chandra appeared for the appellants who are MIC president Datuk Seri G. Palanivel, former MIC secretary-general A. Prakash Rao, and party vice-presidents Datuk S.Sothinathan and Datuk S. Balakrishnan.

The four MIC senior leaders are appealing the June 15 High Court dismissal of their bid to uphold the party's 2013 polls results.

On June 15, the Kuala Lumpur High Court threw out two bids to set aside the RoS directive for MIC to conduct re-elections.

On March 20, the court gave the green light to the two judicial review applications by MIC strategic director A.K. Ramalingam and Palanivel.

Prakash, Sothinathan and Balakrishnan are co-applicants in Palanivel's legal bid.

They sought a declaration that the decision in MIC's annual general meeting on Nov 30, 2013 was valid and enforceable.

They also sought a court order to strike out the decisions and/or directives of RoS via three letters dated Dec 5, Dec 31, and Feb 2 on the grounds that they contradicted the Societies Act 1966 and the party's constitution.
