End of road for Pua as High Court strikes out 1MDB suit against PM, gov't

KUALA LUMPUR: The suit brought by Petaling Jaya Utara MP Tony Pua against Prime Minister Datuk Seri Najib Razak and the government on the 1Malaysia Development Bhd (1MDB) issue was struck out by the High Court today.

In her judgement, judge Datin Faizah Jamaludin said the Prime Minister did not commit tort of misfeasance, whether in the first limb, which is targeted malice to the plaintiff (Pua).

"The plaintiff had failed to plead the particulars of misfeasance claimed by the plaintiff," she said, ordering RM5,000 as costs.

Faizah made the decision after allowing Najib's application.

On Feb 14, Najib filed an application to strike out the suit brought by Pua on grounds that the Prime Minister is not a civil servant, as claimed by the latter.

Pua had, on Jan 16, filed a suit against Najib for misfeasance in public office over the 1MDB issue, seeking general, aggravated and exemplary damages, interest and costs.
