High Court maintains 10-year jail sentence against businessman Zainulabidin, father of actress Ummi Nazeera

KUALA LUMPUR: The High Court maintained a 10-year jail sentence against 66-year-old businessman Datuk Zainulabidin Mat Akhir for using forged documents related to his second wife’s resignation and transfer of shares in a company 11 years ago.

Judicial Commissioner Datuk Mohamad Shariff Abu Samah today upheld the penalties when he dismissed Zainulabidin’s appeal against his conviction and sentencing.

“Sessions Court judge Norsharidah Awang did not err in her decision when she meted out the sentence against the accused,” he said.

Zainulabidin, father of actress Ummi Nazeera, was appealing to overturn a Sessions Court ruling that convicted him on 10 counts of using forged documents, including a “Security Transfer” form for a transfer of 1,680,000 units of shares of Mutiara Efektif (M) Sdn Bhd belonging to his wife, Datuk Seri Maziah Musa, 51, to his son, Ahmad Fikhri, on Dec 26, 2006.

Zainulabidin allegedly committed the offence at the Indah Secretarial management office in Sentul Raya Boulevard, Sentul, in December 2006.

He was also charged with using a forged document dated Dec 22, 2008, for the transfer of ownership of 299,999 B.TIS Manufacturer Sdn Bhd company shares from Maziah to himself between December 2008 and May 2009.

Zainulabidin, who is The wheelchair-bound, was also charged with using forged documents on Mutiara Efektif’s board of directors’ resolution dated Dec 26, 2012, on the appointment of Fikhri as director and the resignation of Maziah as director.

The offence under Section 471 of the Penal Code carries a maximum 20 years’ jail and a fine upon conviction.

The lower court sentenced him to between one and 10 years’ imprisonment for all of offences. The jail terms run concurrently from today.

Shariff also rejected Zainulabidin’s counsel Datuk Seri Jahaberdeen Mohamed Yunos’s application for a stay of execution pending appeal at the Court of Appeal.
