No further action on Klang marathon organiser

KLANG: The Attorney-General's Chambers has declared a NFA (No Further Action) on the investigation papers (IP) into the failure of Klang City International Marathon organiser to obtain a licence or apply for one from the Sports Commissioner to hold the event last December.

Klang Selatan district police chief Assistant Commissioner Shamsul Amar Ramli said the IP was classified as NFA by the Attorney-General's General Crimes and Public Order Unit chief on Feb 12.

"The order was done on the directive of the Attorney-General with the reason that Section 36(1) of the Sports Development Act 1997 is not an offence that can be accusable and it was subsequently classified NFA," said Amar in a statement today.

On Dec 10 about 4.30am during the marathon, runner Evelyn Ang, 44, was hit by a car at the 14th kilometre point of the marathon, along with two others, Ahmad Hadafi Yus, 42, and Amiruddin Hamid, 37.

Ang remains in a critical condition and still on life support at the Sungai Buloh Hospital. Hadafi and Amiruddin sustained light injuries in the incident.

Amar said the assistant Sports Commissioner was informed about the accident by the Sports Commissioner about 3.10pm on Dec 10 last year.

Further checks revealed that the organiser, Earth Runners International Group Sdn Bhd, did not have a licence and had failed to secure one from the Sports Commissioner to hold the event.

The case was subsequently investigated under Section 36 (1) of the Sports Development Act 1997.

Section 36(1) of the Sports Development Act reads: “A company shall not involve itself in any sporting activity or in any other activity related to sports, as may be prescribed by the Minister in the regulations, unless it is licensed to do so by the Commissioner.”
