Indonesian escapes gallows, freed from charge of killing co-worker

SHAH ALAM: An Indonesian construction worker escaped the death sentence after the High Court here today freed him of a charge of killing his Bangladeshi co-worker in May last year.

Judicial commissioner Datin Zalita Zaidan freed Suri, 41, after ruling that the prosecution had failed to established a prima facie case against the accused.

Zalita said the prosecution had failed to call an important witness and this had weakened their case.

Suri, who is from Madura, Indonesia - along with another person still at large, was accused of killing Bangladesh national Mohamad Ali Ashraf, 28.

He was accused of committing the offence at the Rapid bus depo construction site, Kawasan Perindustrian Batu Caves, Gombak, about 11.45am on May 11, 2017.

The offence, under Section 302 of the Penal Code, carries the mandatory death sentence.

The prosecution was conducted by deputy public prosecutor Devinderjit Kaur Gill while Suri was represented by Mohd Irwan Sumadi.

A total of 10 witnesses were called since trial started on Sept 4 last year.

Suri was rearrested immediately after he walked out of the courtroom for failure to have travel documents.
