Car salesman gets 18 months' jail, whipping for cheating customer

KUALA TERENGGANU: A car salesman was sentenced to 18 months’ jail and three strokes of the rotan at the Magistrate’s Court here today for cheating a customer out of RM6,900 in a botched car deal.

Magistrate Abdul Hayyi Salim handed down the sentence after the accused, Mohd Sahmir Dahalan, 34, pleaded guilty to three counts of cheating. He was charged under Section 420 of the Penal Code.

According to the first charge, the accused was alleged to induced Puteh@ Mohd Nor Md Amin, 70, to pay him RM3,200 in front of a house in Kuala Ibai here at 3.20pm on Dec 14, 2018.

He was also charged with inducing the victim to pay him RM3,000 in front of the Puspakom office at Jalan Kubang Ikan, Chendering, here at 3pm on Dec 18, 2018.

For the third charge, the accused was alleged to have induced the victim to pay him RM700 in front of an eatery at Jalan Bukit Kecil here at 9am on Dec 21, 2018.

For the first and second charge, the court sentenced the accused to 18 months in prison and one stroke of the rotan. The accused was sentenced to 12 months in prison and one stroke of the rotan for the third charge.

The prison sentences are to run concurrently.

Deputy public prosecutor Nur Zafirah Rosli prosecuted the case while the accused was unrepresented.

According to the facts of the case, the victim had agreed to purchase a Mercedes Benz car from the accused for RM9,000.

After paying the deposit for the car, the victim lodged a police report on Jan 6 after the accused failed to deliver the car and claimed that it had been sold to another person.
