Somalian grad discharged of molesting woman at KL monorail station

KUALA LUMPUR: A Somalian business graduate is no longer facing a charge of outraging the modesty of a female corporate executive at the Hang Tuah Monorail Station here in 2015.

Mubarik Hassan Hashi, 35, was granted a discharge not amounting to an acquittal by magistrate Siti Radziah Kamarudin on Jan 29, 2016.

His lawyer Auzan Hasanuddin Sazali has confirmed that he (Mubarik) was acquitted of committing the offence against the then 24-year-old woman.

According to the charge sheet, the offence was allegedly perpetrated in a monorail train at the Dang Wangi station at 6.10pm on June 3, 2015.

On June 16 that same year, Mubarik claimed trial to the charge under Section 354 of the Penal Code.

Auzan said that Siti Radziah made the ruling when deputy public prosecutor Nor Diana Nor Azwa informed the court that the prosecution would not proceed with the case.

He said this was because the complainant in the matter was no longer interested in proceeding with the matter.

“The court had returned the bail amount (RM3,500) to the two bailors, who were his (Mubarik's) wife and mother-in-law, as well as returned his passport,” Auzan said.

When Mubarik was charged, he was ordered to surrender his passport to the court as part of his bail conditions.

Auzan added that Mubarik, who graduated in 2016, was greatly relieved by the court ruling and wished to move on with his life.
